{"id":1482,"date":"2016-09-05T11:10:45","date_gmt":"2016-09-05T11:10:45","guid":{"rendered":"http:\/\/www.bainesjewitt.co.uk\/blog\/?p=1482"},"modified":"2016-09-05T11:10:45","modified_gmt":"2016-09-05T11:10:45","slug":"taxpayers-challenging-hmrc-increasingly-likely-to-come-out-on-top-says-study","status":"publish","type":"post","link":"https:\/\/www.bainesjewitt.co.uk\/blog\/taxpayers-challenging-hmrc-increasingly-likely-to-come-out-on-top-says-study\/","title":{"rendered":"Taxpayers challenging HMRC increasingly likely to come out on top, says study"},"content":{"rendered":"<p>A new study has revealed that UK taxpayers who challenge HM Revenue &amp; Customs (HMRC) are increasingly likely to come out on top.<!--more--><\/p>\n<p>The news comes after data analysed by law firm Pinsent Masons found a significant rise in the number of taxpayers \u2018getting the results they want\u2019, while tax authority decisions were increasingly being amended or \u2018thrown out\u2019 at Tribunals.<\/p>\n<p>Pinsent Masons found 57 per cent of cases re-assessed by a secondary HMRC officer had found in favour of the taxpayer for the year to 31 March 2016.<\/p>\n<p>Furthermore, research from HMRC themselves highlighted that the number of decisions appealed to an independent Tribunal which fell in favour of the taxpayer had increased by 5 per cent in the last year.<\/p>\n<p>Such decisions sat at 18 per cent in the 2015\/16 financial year, comparable with 13 per cent in 2014\/15.<\/p>\n<p>Pinsent Masons\u2019 spokesperson, Heather Self, suggested that the majority of HMRC wins could be attributed to complex tax avoidance cases, whereas smaller, less complicated disputes were increasingly \u2018falling in favour\u2019 of taxpayers.<\/p>\n<p>\u201cMany of HMRC\u2019s recent successes relate to complex avoidance schemes implemented some years ago.
